In May 2009, the worker lodged an Application for Compensation for an injury to his right elbow which was accepted and benefits were paid from 16 May 2009 to 9 May 2010.

During the compensation period, the worker returned to work as a support worker/carer between 3 March 2010 to 27 April 2010 and failed to notify WorkCover.

On 27 April 2011, the man pleaded guilty to one charge of fraud and eight false and misleading charges. He was sentenced to six months wholly suspended for all charges for an operational period of 12 months and conviction recorded. He was ordered to pay restitution of $24,870 and costs.
