Case 2

The worker suffered an injury to her knee, in the course of her employment in January 2009. The claim was accepted and compensation benefits were paid for the period 22 January 2009 to 3 April 2009. The worker was required to undergo surgery on 4 March 2009 and was certified unable to work at all.

Despite her certification the worker returned to work as a taxi driver on 10 March 2009 and failed to disclose this employment to WorkCover.

On 13 July 2010 the worker pleaded guilty to one charge of fraud and two charges of providing false and misleading information and was sentenced in Townsville Magistrates Court and fined $1,000 and ordered to pay restitution of $2,324 and costs.
