Background

The worker sustained injuries when he fell into a trench. He was 48 years old at the time of his injury and has since remained employed with BP Refinery. He suffered at least a 21% WPI and had ongoing back issues which impacted his home and work duties.

Judgement

Liability was admitted. The injured worker was awarded $578 000 for his physical injuries.
